TCS BPO harassment probe deepens as police find evidence of wider misconduct

< />Mumbai: The Nashik city police, probing alleged harassment and coercion at a <a id=” captionrendered=”1″ data-src=”https://etimg.etb2bimg.com/photo/130271507.cms” height=”442″ href=”http://hr.economictimes.indiatimes.com/tag/tata+consultancy+services+bpo” keywordseo=”tata-consultancy-services-bpo” loading=”eager” source=”keywords” src=”https://hr.economictimes.indiatimes.com/images/default.jpg” type=”General” weightage=”20″ width=”590″></img>Tata Consultancy Services BPO unit, have uncovered social media exchanges suggesting more employees may have faced similar misconduct but are yet to come forward, senior officers told ET.</p>
<p>“These chats indicate the accused had discussed other coworkers,” one of them said, requesting anonymity. “When existing complainants were questioned, they said several others may have faced similar harassment but have so far stayed silent due to fear of retaliation or job loss,” the person added.</p>
<p>Another officer said the police have urged employees from the unit to come forward. “However, one must understand the underlying socio-economic implications this case highlights, which may be discouraging them from filing complaints,” the officer said. So far, seven of the eight accused have been arrested while one is allegedly absconding.</p>
<p>Between March and April, two city police stations in Nashik registered nine complaints against the accused, alleging workplace misconduct, including mental and sexual harassment, sexually coloured remarks, inappropriate comments on appearance, and repeated attempts at unwelcome physical proximity. Complainants have also alleged religious insensitivity.</p>
<p>“Victims and their families approached the police, following which a case was registered after preliminary enquiry,” Nashik district collector Ayush Prasad told ET.</p>
<p>An email sent to <a botkeyword=TCS did not elicit a response until press time on Tuesday.

“The police probe is focused on alleged criminal misconduct. It will examine whether there was a larger conspiracy, who within the system were aware, and whether there were deliberate acts of omission or commission to suppress complaints,” one of the officers said.

Over 70 emails retrieved from the arrested Nashik-based operations manager were sent to a Pune-based senior, who has also been arrested, the person said. Some of these emails flagged complaints against the accused.

“Preliminary findings suggest the emails were overlooked as the accused were seen as strong performers. The probe is examining whether there was any preferential treatment,” the officer said. Authorities are examining the company’s compliance with workplace harassment laws.

In its response to a notice issued by the assistant commissioner (women and child development), TCS said it had constituted an Internal Complaints Committee (ICC) under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, but no complaints had been brought before it.
